Penalties for a Homicide by Vehicle Conviction
Under O.C.G.A. 40-6-393(a), any person who, without malice aforethought, causes death to another person while in violation of O.C.G.A. 40-6-391 (driving under the influence of alcohol or drugs), commits the offense of homicide by vehicle in the first degree, punishable by 3 to 15 years in prison.
Under Section 40-6-393(b), any driver of a motor vehicle who, without malice aforethought, causes an accident which causes death to another person while the violator is leaving the scene in violation of subsection (b) of Code Section 40-6-270, commits homicide by vehicle in the first degree, punishable by 3 to 15 years in prison.
Under Section 40-6-393(c), anyone who accidentally causes the death of another person, but not while under the influence of drugs or alcohol, or while fleeing the scene, commits homicide by vehicle in the second degree, a misdemeanor offense, punishable by up to a $1,000 fine, or up to 12 months in jail, or both.
